AWWA Legislative Affairs Provided Summary on Buy America

In April, the White House released "Buy America" guidance. The Infrastructure Investment and Jobs Act (IIJA) passed in late 2021 prompted this guidance and, by May 14th, 2022, federal agencies awarding funds for infrastructure projects will enact Buy America preferences in the terms and conditions. The Buy America guidance applies to all federal funds for infrastructure projects, not just those provided for in the IIJA, even if the project is not primarily or solely funded by federal funds.

Water and wastewater projects are subject to this guidance which applies to the iron and steel, manufactured products, and construction materials used. Three types of waivers will be available for use, which will be subject to public comment and review as well as approval by the federal agency awarding funds.
